them carefully before completing your purchase.
1. General
The website www.marikarene.com
is operated by Marika
René Art and her company Marshandmallow AB ("we",
"us", "our").
These terms apply to all purchases,
orders, and visits to the website.
By using the site, you confirm
that you are at least 18
years old or have
permission from a parent or guardian.
We comply with Swedish
law, including the Consumer
Sales Act (KköpL)
and the Distance and
Off-Premises Contracts Act.
2. Products
All artworks and prints on the
website are created by Marika
René.
Original
paintings are unique
and sold only once. Prints and reproductions may be available in
limited editions.
We strive to display our artworks as true to the original as possible. However, colors and tones may vary slightly due to lighting conditions and individual screen settings.
3. Prices and Payment
All prices are stated in Euro (EUR) or Swedish Kronor (SEK) and
include VAT.
Payment can be made using the methods provided at
checkout (e.g., credit card or Klarna).
We reserve the right to correct typographical errors, adjust prices, and update availability.
4. Shipping and Delivery
All artworks are shipped within
7 days
of purchase, unless otherwise stated.
Shipping costs depend on
the size of the artwork and are shown at checkout before you complete
your order.
We ship both within
Sweden and internationally. Please note, we do not deliver products to a number of restricted and prohibited regions and countries.

5. Right of Withdrawal and Returns
According to Swedish law, you have a 14-day right of withdrawal from the date you receive your order, except for custom-made or personalized artworks.
For returns, you are responsible
for return shipping costs unless the return is due to damage or an
error on our part.

6. Complaints
If you receive an item that is
damaged, defective, or incorrect, please contact us as soon as
possible and within a reasonable time and include
photos and details.
If your complaint is approved, we will cover
the return shipping costs.
7. Complaint Period, Guarantee, and Burden of Proof
Complaint Period
As
a seller, we are responsible for any original defects in the product
for three years
from the date of purchase.
For goods with digital components,
such as built-in technology, the responsibility applies for three
years or the duration of the agreement
(Chapter 4, Section 14 of the Consumer Sales Act).
Consumers must report defects within a reasonable time. Reporting within two months of discovering the defect is always considered reasonable (Chapter 5, Section 2).
Guarantees
If
a guarantee is provided for a product, the consumer is entitled to
the rights stated in the guarantee terms (Chapter 4, Sections
21–23).
Guarantees are voluntary and complement, but do not
replace, statutory consumer protection.
Any guarantee terms that
limit statutory rights are invalid and may violate the Terms
of Contract Act (AVLK).
Burden of Proof
During
the first two years
after delivery, the seller bears the burden of proof.
This means
that any defect appearing within this period is presumed to have
existed at the time of delivery, unless the seller can prove
otherwise (Chapter 4, Section 17).
This rule cannot be waived or
excluded by agreement. Attempting to do so may also violate the Terms
of Contract Act (AVLK)
and the Marketing
Act (MFL).
8. Intellectual Property Rights
All images, texts, and artworks
on www.marikarene.com
are protected by copyright
law.
No
material may be copied, reproduced, or used without written
permission from Marika
René Art.
9. Personal Data
We process personal data in
accordance with the EU
General Data Protection Regulation (GDPR).

10. Disputes and Governing Law
We comply with Swedish
law and always
strive to resolve disputes in dialogue with our customers.
If we
cannot reach an agreement, you may contact the National
Board for Consumer Disputes (ARN)
or use the EU Online
Dispute Resolution (ODR)
platform.
The applicable law is Swedish
law.
